1.1 These GTC apply to the legal relationship established between BFK GmbH and the respective customer through the purchase of table reservations and, if applicable, consumption vouchers, pre-ordered menus and snack boards, as well as admission tickets and admission wristbands. The contract shall be governed exclusively by these GTC. Other contractual or business terms and conditions shall not become part of the contract, even if the marquee does not expressly object to them. The effectiveness of the legal relationship mentioned in sentence 1 is subject to the condition precedent of the approval of the "Festzelt" for the Oktoberfest/Oide Wiesn (granting of a marquee concession) by the City of Munich and the responsible authorities.
1.2 Subject to change: BFK GmbH is entitled to change or deviate from the service owed in a manner that is reasonable for the client, taking into account the client's interests.
1.3 Liability
2.1 Subject matter of the contract: The subject matter of the contract is the reservation of tables in the festival tent on a specific day for a specific period on the occasion of the Munich Oktoberfest/Oide Wiesn as well as the purchase of consumption vouchers, if applicable, the purchase of menus and snack boards, as well as admission tickets and admission wristbands (hereinafter: "reservations"). Reservations can only be made for tables of 10 people. To make a reservation, each person aged 12 and over must purchase an admission wristband for the Oidn Wiesn festival grounds - on which the festival tent is also located - for the specific day. These admission wristbands are sold by the festival tent in the name and on behalf of the City of Munich. A minimum purchase of vouchers per person is required. In the case of a reservation, the seats for the number of persons specified in the reservation will be made available to the customer for the agreed reservation time. If the customer does not appear at the latest 15 minutes after the reservation time specified in the reservation, BFK GmbH may release the reserved seats. Exact seating requests will be taken into account as far as possible, but cannot be guaranteed. During the stay at the agreed reservation time, any purchased food vouchers can be redeemed in the marquee and pre-ordered menus and snack boards can be consumed.
2.2 Reservation requests: Reservation requests can only be made via our website Schützenlisl Festzelt Schützenlisl using the online form.
Online reservation request: In the case of a reservation request via the website, the reservation is made as follows: To make a reservation request, it is necessary to register on the online presence of the marquee. The overview of reservation dates provided there does not constitute a contractual offer, but merely an invitation from the marquee to the customer to submit a reservation request. The customer submits a non-binding reservation request via the online command provided for this purpose. After sending this, the customer automatically receives a confirmation of receipt. Within 3 - 5 working days, the customer will receive a personal reply from the reservation team as to whether the reservation as requested is actually possible. After official approval of the marquee for this year's Oktoberfest by the City of Munich and the responsible authorities, the customer will receive a personalized offer, which must be reconfirmed within the specified period, subject to prior positive feedback. Once the customer has accepted the offer and confirmed that they have read and accepted these General Terms and Conditions, they will receive a pro forma invoice for the amount to be paid. Upon payment of the full amount within 7 days, from 15.08.2026 within 2 days, the reservation becomes binding and a corresponding contract is concluded with regard to the reservation. After receipt of payment, the customer will receive confirmation of receipt of payment via the portal. The documents (admission wristbands, admission tickets, any consumption vouchers etc.) will only be sent by post and only within Germany. The admission wristbands will be sent abroad. The vouchers can be collected from the "Schützenlisl" festival office at the Oidn Wiesn from the first official Wiesn day.
2.3 Visitor rights: There is a designated area in the festival tent for unreserved seats. Every visitor has free access to the marquee as long as the unreserved seats are available. Admission is granted to visitors who have purchased a reservation directly from the marquee or as part of a permitted transfer in accordance with section 7.3, who can be identified by the individualization features printed on the admission tickets (e.g. printed name) or who have purchased reservations in accordance with section 7.3. As proof of their reservation, visitors must present their reservation number at the request of the marquee and/or persons authorized by the marquee (e.g. security personnel). Reservation confirmations and/or admission tickets purchased on sales or auction platforms on the Internet or from other third parties that are not authorized by the marquee do not convey any right to visit in accordance with this section and may trigger legal consequences in accordance with section 7.4. The marquee fulfills its obligations with regard to the customer's or ticket holder's right to visit by granting one-time access to the marquee at the beginning of the reservation period, making the reserved seats available and redeeming any consumption vouchers already purchased and allowing ordered menus and snack boards to be consumed. The marquee shall also be released from its obligation to perform if the admission of the respective persons to the marquee fails due to the aforementioned required individualization of the customer(s). Any consumption vouchers, menus and snack boards that cannot be redeemed as a result shall also expire in full. The admission wristbands sold in the name and for the account of the City of Munich (in conjunction with the reservation confirmation and the admission tickets for the festival tent) give the respective holder the right to enter the Oide Wiesn festival grounds for the specific period reserved on the respective day of the event. As the marquee is located on the Oide Wiesn festival grounds, the corresponding admission wristbands must also be purchased in order to visit the marquee.
3.1 Prices: The minimum consumption (vouchers / pre-orders / menus) must be paid no later than 7 days after receipt of the invoice, from 15.08.2026 within 2 days, otherwise the reservation will expire. In the case of advance payments for the minimum consumption by foreign bank transfer, any bank charges incurred shall be borne by the customer. Payments on site by the customer are to be made in cash or Visa/Master/EC card without any deductions immediately before leaving BFK GmbH. A payment term is only possible with a separate agreement which must be confirmed in writing by BFK GmbH in advance. We ask you to check invoices on the spot, as later complaints can no longer be considered. A handling/shipping fee of 19.50 euros will be charged per domestic shipment. There is no shipping abroad. The vouchers are available for collection from the office at Sendlinger Straße 24, 80331 Munich. In addition, all bills must be paid directly in the marquee. You are responsible for settling the bill with your waiter. A later complaint via the festival office cannot be granted. The price per person for the admission wristbands for the festival grounds of the Oide Wiesn will be communicated by the festival tent after determination by the City of Munich at the latest when the pro forma invoice is sent to the customer. Any bank transfer costs are to be borne by the customer.
3.2 Cancellation: Cancellations must be made in writing by e-mail to rsrvrngschtznlsld or the reservation portal. Withdrawal from the reservation does not entitle the customer to exchange the purchased vouchers, unless BFK GmbH is responsible for the withdrawal.
3.3 Exclusion period: In principle, a deposit of 100% must be paid. After receipt of the reservation, an advance invoice will be sent by BFK GmbH and the client must pay this invoice within 7 days of the invoice date. If payment is not received on time, the reservation will be automatically canceled. There will be no further request for payment.
4.1 Admission: Admission to the marquee is only guaranteed for the customer and his guests with reservation confirmation and admission tickets on the confirmed reservation date. As the marquee is located on the Oide Wiesn festival grounds, successful entry to the Oide Wiesn festival grounds and thus the purchase of appropriate admission wristbands by the customer and his guests, as well as the reservation confirmation, are equally essential prerequisites for admission to the marquee. The customer may not bring food and drink for consumption. Furthermore, he is not entitled to employ third party service providers in the field of decoration and entertainment in any form on the premises of BFK GmbH without the consent of BFK GmbH.
BFK GmbH expressly reserves the right to exercise its domiciliary rights. The reserved seats must be taken punctually and in full. The marquee is not obliged to keep the reserved seats free for the customer for longer than 15 minutes after the start of the confirmed reservation time. In the event of non-compliance with legal regulations (in particular the absolute ban on smoking in the marquee, including e-cigarettes), the guest will be expelled from the marquee. For security reasons, the festival tent or persons authorized by it are entitled to carry out a bag check at the entrance. Due to the fact that the festival tent is committed to maintaining the Oktoberfest tradition (hence its location on the Oide Wiesn festival grounds), customers and their guests are prohibited from standing and dancing on benches and tables (however, it is possible to dance to traditional brass band music on the "dance floor"). For the same reason of the marquee's obligation to maintain the Oktoberfest tradition, the marquee or persons commissioned by it are entitled to refuse admission to the customer and his guests without replacement or to expel them from the marquee if they are obviously dressed inappropriately with regard to the Oktoberfest tradition (e.g. obvious outfit for a stag party or masquerade). In the aforementioned cases, the customer and/or his guests are not entitled to any claim for damages against the marquee. The marquee also reserves the right to exercise its domiciliary rights and refuse admission to the marquee to persons who belong to neo-Nazi organizations or are associated with the extreme right-wing scene or who have already made anti-Semitic, racist or nationalist statements in the past. Even in such cases, the customer and/or his guests are not entitled to any compensation from the marquee.
4.2 Seating: The reservation is only valid for the table reservation stated in the reservation confirmation and for the duration of the scheduled reservation time. We reserve the right to change tables to other areas (regardless of whether Stubn or Mittelschiff has been requested or confirmed by us via the reservation portal) without prior notification to the guest. The final table reservation will be announced on the day of the reservation. We make every effort to accommodate the seating preferences of each guest.
Unoccupied seats of a table reservation can be allocated to other customers by the marquee 15 minutes after the start of the reservation. When leaving the marquee, the entitlement to the reserved seats expires. The passing on of drinks and/or food to persons standing in the aisle is prohibited. After the reservation time has expired, the seats must be vacated completely. For safety reasons, lingering in the aisles after this time is just as prohibited as within the confirmed reservation time.
4.3 Consumption vouchers: Chicken, beer and value vouchers can be redeemed in the Munich restaurants of Münchner Suppenküche (Viktualienmarkt, Sendlinger Str. 7, Theresienhöhe Franziska-Bielek-Weg) and in the delicatessen stores of Schlemmen am Markt (Viktualienmarkt & Elisabethmarkt) from the first day after the end of the Wiesn until 31.10. of the same year. A refund, exchange or payment of unredeemed vouchers is not possible.
4.4 Menus/snack boards: Pre-ordered menus and/or snack boards are prepared for the specific reservation time and can be consumed during this time. In the event of non-appearance or non-utilization without prior cancellation to the marquee (cancellation must be made via the portal of the reservation made under the respective reservation number/process number), a refund or later (alternative) redemption is excluded in any respect and the customer is not entitled to any other claims against the marquee in this regard. If the entire reservation is canceled in advance (at the latest 1 day before the start of the reservation/24 hours), the menu/bread boards can either be redeemed on another day, or the value of the pre-order will be exchanged for vouchers and can thus be redeemed until 31.10. of a year in the city center restaurants - see § 4.3. Only the entire cancellation according to the invoice issued in advance is possible. Partial cancellation or partial conversion into vouchers is excluded.
5.1 Visitors with a German address: The admission wristbands and the consumption vouchers ordered as part of the table reservation will be sent to the customer in the case of sections 2.2.1 and 2.2.2, with the marquee selecting the shipping company. The courier service shall hand over the documents personally to the recipient or a third person (e.g. a neighbor), whereby the name of the person shall be documented by the courier service. If no one can be found, the documents may be posted in the letterbox. Our liability for the further whereabouts of the documents ends with their delivery or deposit. Dispatch takes place after full receipt of payment, but at the earliest from 20.07. to 10.09. of the same year. Thereafter, the vouchers ordered as part of the table reservation can be collected from the Schützenlisl festival office at the Oidn Wiesn in the Schützenlisl tent daily between 10:00 and 17:00 from the first official Wiesn day. The invoice and ID card must be presented for this purpose.
Visitors with a foreign address: No admission wristbands will be sent out. The food vouchers ordered as part of the table reservation can be collected from the first official Wiesn day as follows:
The invoice and ID card must be presented. The admission wristbands will be issued after full payment has been received, but at the earliest from 20.07. to 15.08. of the same year.
6.1 No right of revocation or return: Even if the marquee offers reservations via means of distance communication within the meaning of § 312c para. 2 BGB (German Civil Code) and thus a distance contract may exist in accordance with § 312c para. 1 BGB, the customer has no right of revocation when purchasing a reservation in accordance with § 312g para. 2 no. 9 BGB. This means that there is no two-week right of withdrawal and return.
7.1 Purpose: In order to enforce house bans and to maintain the widest possible supply of reservations to the general public at socially acceptable prices, it is in the interest of the festival tent, its customers and visitors to the Oktoberfest to restrict the unauthorized transfer of reservations in order to prevent price speculation (e.g. the purchase of reservations with the aim of direct resale and/or the resale of reservations at inflated prices).
7.2 Prohibited transfer: The sale of reservations is exclusively for private, non-commercial (i.e. profit-oriented) use by the customer; any commercial or industrial resale or other unauthorized transfer of the reservations (i.e. reservation confirmations and/or admission tickets and/or admission wristbands) by the customer is prohibited. In particular, the customer is prohibited from a) selling reservations publicly, in particular at auctions and/or on the Internet (e.g. on Ebay, Ebay classifieds, Facebook) and/or on sales platforms not authorized by Festzelt (e.g. viagogo, oktoberfest-tischreservierungen.de, tischreservierung-oktoberfest.de etc.) b) to offer reservations to commercial and/or commercial resellers and/or dealers (e.g. oktoberfesttischreservierungen.de or tischreservierung-oktoberfest.de), to sell them or pass them on; c) to use or allow reservations to be used commercially or commercially without the express prior written consent of Festzelt, in particular for the purposes of advertising, marketing, as a bonus, as a promotional gift, as a prize or as part of an unauthorized hospitality or travel package; d) to pass on reservations to persons who are banned from the premises, provided that the customer was aware or should have been aware of this circumstance.
7.3 Permitted passing on: Private passing on of a reservation (i.e. reservation confirmations and/or admission tickets and/or admission wristbands) for non-commercial reasons, in particular in the event of illness or other prevention of the customer, is permitted if there is no case of unauthorized passing on within the meaning of the provision in Section 7.2. The customer may only transfer the rights and obligations arising from the contract concluded with the marquee (and thus also the right to visit) to a third party by the third party entering into the contract with the marquee in his place and assuming all rights and obligations. This entry requires the consent of the marquee, which is hereby granted in advance under the following conditions, if: a) the customer expressly informs the new holder of the reservation of the validity and content of these GTC, b) the new holder of the reservation agrees to the validity of these GTC between him and the marquee and c) the marquee is informed in good time of the transfer of the reservation, naming the new holder of the reservation, or the marquee has implicitly declared the transfer to the new holder of the reservation to be permissible. The transfer of individual rights from the contract concluded with the marquee, in particular the right to visit, is excluded in the absence of one of the conditions described in a) to c). If a contractual partner has permissibly acquired several visiting rights for the marquee within the framework of a contract concluded with the marquee and permissibly assigns these visiting rights to several third parties, separate contracts are concluded between the marquee and the persons entering the marquee. The customer Festzelt Volkssängerzelt Schützenlisl - BFK GmbH will inform its customers or guests of this obligation and ensure that traded table reservations via the secondary market of Oktoberfest-Booking.com remain valid. The use of the Oktoberfest-Booking.com website for trading with table reservations of the own marquee is in accordance with the requirements of the city council resolution of the city of Munich.
7.4 Measures in the event of unauthorized forwarding: In the event of one or more violations of the provision in section 7.2 and/or in the event of other unauthorized forwarding of reservations (i.e. reservation confirmations and/or admission tickets and/or admission wristbands), the marquee is entitled, subject to the imposition of a contractual penalty in accordance with section 8, a) to reject reservation confirmations and/or admission tickets and/or admission wristbands that have been handed over or sent to the customer contrary to the provisions in section 7.3. (b) to block the reservations concerned and to refuse the holder of the reservation and his guests access to the marquee without compensation or to expel him from the marquee and, if applicable, to invalidate all (as yet) unredeemed consumption vouchers without compensation. c) to exclude affected customers from purchasing a reservation for a reasonable period of time, but for a maximum of five (5) years; the number of violations, the number of reservations offered, sold, passed on or used and any proceeds generated by the resale shall be decisive for the length of the ban; d) in the event of an unauthorized passing on of reservations in accordance with Section 7.2, to demand payment of the additional revenue or profit achieved from the respective customer in accordance with Section 9 of these GTC; e) to report the incident in an appropriate manner, also stating the name of the customer, in order to prevent any future use of the reservation in breach of contract.
The following promise of a contractual penalty serves primarily to induce the customer to comply with the obligations to cease and desist promised by him in accordance with Section 7.2 of these GTC in such a way that he is deterred from (further) violations due to the promised penalty.
8.1 Prerequisites: In the event of a culpable breach of these GTC by the customer, in particular against one or more of the provisions in Section 7.2, Festzelt is entitled, in addition to the other measures and sanctions possible under these GTC and without prejudice to any further claims for damages, to impose a reasonable contractual penalty of up to EUR 2,500 on the customer.
8.2 Amount: Decisive for the amount of the contractual penalty are in particular the number of infringements, any proceeds or profits generated by the unauthorized disclosure, the type and degree of fault (intent or negligence), efforts and successes of the customer or holder of the reservation with regard to a damage claim. The exact amount of the contractual penalty shall be determined by the customer or reservation holder with regard to compensation for damages, necessary expenses for the prosecution of infringements, the question of whether and to what extent the customer or reservation holder is a repeat offender and, in the case of unauthorized resale of reservations, the number of reservations offered, sold, passed on or used. The exact amount of the contractual penalty shall be determined by Festzelt in each individual case at the reasonable discretion of BFK GmbH and, in the event of a dispute, shall be reviewed for its appropriateness by the competent court. The contractual penalty shall be offset against any claims for damages by the marquee due to the infringement.
9.1 Prerequisites: In the event of an unauthorized transfer of reservations by the customer in accordance with section 7.2, the marquee is entitled, in addition to the imposition of a contractual penalty in accordance with section 8 and in addition to the other sanctions possible under these GTC, to have the customer or holder of the reservation pay out all or part of the additional proceeds or profit generated by the unauthorized transfer of a reservation (i.e. reservation confirmations and/or admission tickets and/or admission wristbands).
9.2 Amount and use: The criteria set out in clause 8.2 and the amount of any contractual penalty imposed shall be decisive for the question of whether and to what extent the additional proceeds must be paid out.
10.1 The following provisions apply to access and stays in the marquee, which are subject to special conditions, regulations and/or requirements etc. imposed by authorities or other state institutions in connection with the SARS-CoV-2 pandemic:
10.2 The customer or reservation holder acknowledges that the Oktoberfest may not be able to take place in the manner originally intended, in particular due to legal, regulatory and official requirements, regulations and/or specifications etc.; in particular, the customer acknowledges that the holding of and participation in an event in the marquee may be subject to compliance with additional rules, regulations and requirements by the marquee. The customer accepts that, in order to protect the health of customers and employees, the marquee may, at its reasonable discretion, also stipulate appropriate rules of conduct and hygiene that go beyond the statutory, regulatory or official requirements, regulations and/or specifications, which it shall oblige customers and their guests to comply with.
10.3 The marquee is entitled to cancel reservations of individual customers to reduce the number of visitors if this becomes necessary due to legal, regulatory or official orders or comparable measures. In the event that the event is definitively canceled or the reservation purchased by the customer is canceled, the customer will be refunded the sales price paid.
10.4 The marquee can assign the customer seats of the same or a higher category that differ from his reservation for good cause, for example to comply with distance requirements or to implement protection and hygiene concepts; in these cases, the customer is not entitled to a refund of the sales price or other compensation from BFK GmbH.
10.5. The marquee is entitled to refuse the customer or his guests access to and/or to remain in the marquee without entitlement to reimbursement of the purchased consumption vouchers, pre-ordered menus and/or snack boards, admission wristbands or other compensation and/or to refuse the customer or his guests access to and/or to remain in the marquee without entitlement to reimbursement of consumption vouchers that have not yet been redeemed, vouchers, pre-ordered menus and/or snack boards, admission wristbands or other compensation from the marquee if the customer or his guests do not comply with and/or fulfill the applicable statutory, regulatory and/or official requirements and regulations and/or do not comply with the provisions of the marquee's hygiene and protection concept.
10.6 If, for good cause, in particular on the basis of legal, regulatory or official requirements or the marquee's protection and hygiene concept, the presentation of evidence and/or declarations by the customer and his guests is required for access to the marquee, the marquee is entitled, in accordance with the relevant data protection regulations, to make the granting of access to the marquee dependent on the presentation of such evidence and/or declarations and to check the evidence and/or declarations presented.
10.7 The marquee points out that it may be obliged to record the contact details of the customer and his guests and pass them on to the competent authority in order to trace chains of infection. The customer will therefore provide the contact details of himself and the persons accompanying him (guests) in full and correctly with their consent. The marquee shall process the relevant data in accordance with the relevant data protection regulations (e.g. Art. 6 para. 1 sentence 1 lit. c GDPR in conjunction with the applicable statutory regulations); this also includes forwarding the data to the competent authority.
10.8 The customer and his guests must comply with the instructions and requirements of the marquee and the staff. The customer and his guests acknowledge that even with comprehensive protection and hygiene concepts, the risk of infection with SARS-CoV-2 cannot be completely ruled out when attending an event.
11.1 In other cases of force majeure or similar, the provisions set out in section 10 shall apply mutatis mutandis.
BFK GmbH is entitled to withdraw from the contract for objectively justified reasons, in particular if
BFK GmbH is obliged to inform the customer immediately about the non-availability and will reimburse the customer without delay.
12.1 The marquee does not participate in dispute resolution proceedings before a consumer arbitration board.
13.1 Unless specifically stated otherwise in the GTC, the processing of personal data of the customer and/or the holder of the reservation is carried out on the one hand to fulfill a contract between the marquee and the customer/holder of the reservation in accordance with Art. 6 Para. 1 S. 1 b) GDPR. On the other hand, the processing of personal data of the customer and/or the holder of the reservation is carried out to safeguard the legitimate interests of the marquee. The legitimate interests arise from Section 7.1.
14.1 We do not store the complete text of the contract. Before sending the order via the website, the contract data can be printed out or saved electronically using the browser's print function.
15.1 Choice of law: The law of the Federal Republic of Germany shall apply.
15.1.1 Choice of law for consumers: In the case of consumers who do not conclude the contract for professional or commercial purposes, the choice of law according to clause 15.1 shall only apply insofar as the protection granted is not withdrawn by mandatory provisions of the law of the country in which the consumer has his habitual residence.
15.1.2 CISG: The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.
15.2 Place of jurisdiction: If the customer is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract shall be the registered office of the marquee. The same applies if the customer is an entrepreneur and has no general place of jurisdiction in Germany or if his place of residence or habitual abode is unknown at the time the action is brought. The right of the marquee to appeal to the court at another legal place of jurisdiction remains unaffected by this. Place of jurisdiction and place of performance The contractual relationship is governed by German law; the place of jurisdiction and place of performance for both parties is Munich if the client is a merchant, a legal entity under public law or a special fund under public law.
16.1 Should individual clauses of these General Terms and Conditions be invalid in whole or in part, this shall not affect the validity of the remaining clauses or the remaining parts of such clauses. These General Terms and Conditions shall take precedence over the general terms and conditions of the client BFK GmbH.
